Please read these Terms of Service ("Terms") carefully before using gogylesson.com ("Platform"), operated by Gogy ("we," "our," or "us"). These Terms govern your access to and use of the Platform, including any content, features, and services offered.
By accessing or using the Platform, or by clicking "I Agree," you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform.
1. Eligibility
You must be at least 13 years of age (or 16 in the European Union) to use the Platform. By using the Platform, you represent and warrant that:

2. Account Registration and Google Sign-In
2.1 Account Creation
To access certain features of the Platform, you may be required to create an account. You may register directly or use Google Sign-In to authenticate via your existing Google account. By using Google Sign-In, you authorize us to access and use certain Google account information consistent with our Privacy Policy.
2.2 Account Responsibilities
You are responsible for:

We are not liable for any loss or damage resulting from your failure to protect your account credentials. You may not share, transfer, or sell your account to any third party.
2.3 Account Accuracy
You agree to provide accurate, current, and complete information during registration and to keep your account information updated. We reserve the right to suspend or terminate accounts with inaccurate or misleading information.
3. Use of the Platform
3.1 License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal or internal business purposes.
3.2 Acceptable Use
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not:

Violate any applicable local, national, or international law or regulation

Transmit any unsolicited or unauthorized advertising or promotional material (spam)

Impersonate any person or entity or misrepresent your affiliation with any person or entity

Use automated means (bots, scrapers, crawlers) to access or collect data from the Platform without our prior written consent

Reverse engineer, decompile, or disassemble any part of the Platform

Use the Platform to develop competing products or services
3.3 Third-Party Services
The Platform may integrate with or link to third-party services (including Google). Your use of such services is governed by the respective third party's terms and policies. We are not responsible for the content, accuracy, or practices of any third-party services.
4. User Content
4.1 Your Content
You retain ownership of any content you submit, post, or display on the Platform ("User Content"). By submitting User Content, you grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, publish, and display such content solely for the purposes of operating and improving the Platform.
4.2 Content Standards
You represent and warrant that your User Content:

Is owned by you or you have the necessary rights and permissions to share it

Does not infringe the intellectual property, privacy, or other rights of any third party

Complies with these Terms and all applicable laws
4.3 Content Removal
We reserve the right to remove or disable access to any User Content at our sole discretion, without notice, if we believe it violates these Terms or is otherwise objectionable. We do not assume any obligation to monitor User Content.
5. Intellectual Property
The Platform and its original content (excluding User Content), features, design, and functionality are and remain the exclusive property of gogy and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
Nothing in these Terms transfers any intellectual property rights to you. You may not copy, modify, distribute, sell, or lease any part of our Platform or its underlying code without our explicit written permission.
6. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection, use, and sharing of your information as described in our Privacy Policy. If you sign in using Google, your use of Google's authentication service is also subject to Google's Terms of Service and Privacy Policy.
7. Fees and Payment
Certain features of the Platform may require payment ("Paid Services"). If you choose to use Paid Services:

We use third-party payment processors and do not store your full payment card information. Payment processing is subject to the terms of our payment provider.
8. Termination
8.1 Termination by You
You may stop using the Platform at any time and request deletion of your account by contacting us at gogylesson@gmail.com. Termination does not entitle you to a refund of any fees paid.
8.2 Termination by Us
We may suspend or terminate your access to the Platform at any time, with or without cause or notice, including if we believe you have violated these Terms. Upon termination, your right to use the Platform immediately ceases.
8.3 Effect of Termination
Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
9. Disclaimers
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information on the Platform.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GOGY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS (USD $100).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
11. Indemnification
You agree to defend, indemnify, and hold harmless gogy and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:

12. Governing Law and Dispute Resolution
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States of America, and the state of Delaware without regard to its conflict of law provisions.
12.2 Dispute Resolution
Any dispute arising out of or relating to these Terms or the Platform shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Charlotte, North Carolina under the rules of the American Arbitration Association except that either party may seek injunctive relief in a court of competent jurisdiction to prevent irreparable harm.
12.3 Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive your right to participate in a class action lawsuit or class-wide arbitration.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the revised Terms on the Platform and updating the effective date. Where required by law, we will seek your consent. Your continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms.
We encourage you to review these Terms periodically. If you do not agree to the revised Terms, you must stop using the Platform.
14. Miscellaneous
14.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Platform and supersede all prior agreements and understandings.
14.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
14.3 Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
14.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
14.5 Force Majeure
We shall not be liable for any failure to perform our obligations where such failure results from causes beyond our reasonable control, including natural disasters, war, government action, or internet outages.
